TERMS AND CONDITIONS
Please read these terms and conditions carefully before booking your holiday accommodation. If you have any questions, please do not hesitate to contact us.
1. The Company and Scope of Service
Teneriferentals.es operates as both a property manager for selected holiday accommodations and as an online booking platform connecting holidaymakers (“the Holidaymaker”) with independent property owners (“the Owner”). In these terms and conditions, “the Company” refers to Teneriferentals.es.
For properties directly managed by the Company, the rental contract is formed between the Holidaymaker and Teneriferentals.es. For properties not directly managed by the Company, the rental contract is formed directly between the Holidaymaker and the Owner. In such cases, Teneriferentals.es acts solely as an intermediary and booking facilitator and is not a party to the rental contract.
2. The Holidaymaker
The Holidaymaker is the person named on the booking form and is responsible for the obligations and conditions of hire for all members of their party. The booking is personal to the Holidaymaker and may not be transferred to another party.
The Holidaymaker must notify the Company in writing prior to the start of the booking of any changes to the number of people staying at the property. While the Company will attempt to accommodate such requests, it reserves the right to refuse changes or apply additional charges where appropriate.
3. Booking
Bookings can be made using the online reservation system on the website. If you do not have internet access or wish to discuss your holiday requirements, you may contact the Company by email at booking@teneriferentals.es. The Company reserves the right to refuse any booking.
For properties owned or managed by third parties, specific booking conditions, house rules, payment terms and cancellation policies may apply and will be clearly displayed at the time of booking. By completing a booking, the Holidaymaker agrees to the terms applicable to the selected property.
4. Payment
A booking deposit must be paid at the time of booking and is non-refundable except where required by law. Bookings may be paid by credit card or bank transfer. A booking is only confirmed once the deposit has been received and a booking confirmation email has been sent.
The outstanding balance is payable no later than 14 days prior to the start of the holiday. For bookings made within 14 days of arrival, full payment is required at the time of booking. If the balance is not paid by the due date, the Company reserves the right to cancel the booking and retain the deposit. Where the property cannot be re-let, the Holidaymaker may remain liable for the outstanding balance.
Where the Company acts solely as an intermediary, payments may be processed on behalf of the Owner or redirected to the Owner’s designated payment method, as indicated during the booking process.
5. Use of the Property
The Holidaymaker may access the property from 3:00 pm on the day of arrival unless otherwise stated in the booking confirmation. Early check-in may be possible subject to availability.
All children must be accompanied by a parent or legal guardian at all times. All properties are non-smoking. Smoking is permitted only in designated exterior areas such as balconies or gardens where applicable.
The property must not be used for any commercial purpose. The booking does not create a landlord and tenant relationship. The Holidaymaker has the right to occupy the property only for the agreed holiday period and must vacate the property at the end of that period.
6. Departure
The property must be vacated by 11:00 am on the day of departure unless a later time has been expressly agreed. Unauthorised late departures may result in additional charges.
7. Conduct and Termination
The Company reserves the right to terminate a stay where the Holidaymaker or any member of their party behaves unreasonably, causes damage or nuisance, breaches these terms, or exceeds the maximum permitted occupancy. In such cases, no refund shall be made.
8. What’s Included
Unless otherwise stated, electricity and water are included in the rental price, provided that consumption remains within normal and reasonable usage. Bed linen and towels are provided. Travel cots are available at an additional cost and must be requested at least one week prior to arrival.
9. Pets
Pets may be permitted at certain properties, subject to the specific conditions set by the property owner or manager. Guests wishing to bring pets must request approval in advance of booking. Pets are not allowed unless prior written authorisation has been granted.
10. Cleaning, Damage and Loss
The Holidaymaker must take reasonable care of the property and its contents and leave it in a clean and tidy condition on departure. The Holidaymaker is responsible for the cost of any damage, loss or breakage caused during the stay and must report any such issues to the Company as soon as possible.
Lost property will be retained for a period of two weeks. Unclaimed items may be donated to local charities. The Company accepts no liability for items left at the property.
11. Cancellations
All cancellations must be made in writing. The following cancellation charges apply:
More than 10 weeks before arrival: deposit retained
Between 60 and 15 days before arrival: 50% of the rental price
Between 14 and 0 days before arrival: 100% of the rental price
Failure to arrive at the property on the agreed arrival date without prior written cancellation (“no-show”) will be treated as a cancellation and charged at 100% of the rental price.
12. Liability
The Company shall not be liable for any accident, loss, damage, injury, expense or inconvenience suffered by the Holidaymaker or members of their party, except where such liability cannot be excluded or limited under applicable Spanish consumer and contract law.
Where Teneriferentals.es acts solely as an intermediary, the Company shall not be responsible for the condition of the property, the provision of services, or any acts or omissions of the Owner. Any claims relating to such accommodation must be made directly to the Owner.
13. Circumstances Beyond the Company’s Control
The Company shall not be liable for any change or cancellation resulting from events beyond its reasonable control, including but not limited to fire, flood, extreme weather conditions or epidemics. In such cases, reasonable efforts may be made to offer alternative dates or accommodation, subject to availability, but no refund is guaranteed.
14. Complaints
Any complaints must be reported immediately to the Company during the stay to allow an opportunity to resolve the issue. Claims for compensation made after departure will not be accepted.
15. Access to the Property
The Holidaymaker must permit the Company or its representatives reasonable access to the property for inspection, maintenance or repair purposes.
16. Information Accuracy
Photographs, maps and floor plans are provided for illustrative purposes only. Although all reasonable efforts are made to ensure their accuracy, the Company shall not be held responsible for changes or modifications to the furniture.
17. Fraud Prevention
All reservations offered through Teneriferentals.es are managed through the official contact email booking@teneriferentals.es, which is the primary and authoritative communication channel for booking-related matters. A reservation shall be considered confirmed once the booking details have been agreed and communicated by the
Company through its official channels. Teneriferentals.es cannot be held responsible for bookings, payments or agreements arising from communications that do not clearly originate from or are not verifiable through the official contact details of the website. Holidaymakers are advised to exercise caution and verify any communication claiming to represent Teneriferentals.es by reference to the official contact information published on this website.
18. Your Rights
Nothing in these terms and conditions affects your statutory rights as a consumer.
19. Governing Law
These terms and conditions and any disputes arising from them shall be governed exclusively by Spanish law and subject to the jurisdiction of the Spanish courts.
